Required Trademark Notice – Sites which do not reference Davis

  Web Site Required Trademark Notices

If a Facilitator maintains a business web site that does not reference the Davis program or the Facilitator’s licensing status with DDAI, the provisions for Davis trademark notices and required links do not apply.

However, to avoid possible misunderstandings, Facilitators should inform DDAI and/or their DDA of affiliation of the existence of such web sites.

There is no limit on the number or type of web sites that a Facilitator may maintain. However it is important that DDAI be informed of all sites where Davis® trademarks are used.

A Davis Program cannot be described by any other name

If a Facilitator describes services for dyslexia without referencing Davis, then the site can not use language or include images that are specifically associated with Davis methods.

Davis programs are unique and easily distinguished from other programs in the use of orientation tools, and in the specific clay modeling techniques we use. Therefore, descriptions of orientation or tools such as dial-setting, or references to symbol and concept mastery techniques are closely associated with our program and trademarks. Descriptions of such techniques without referencing the Davis name has the effect of diluting the value of the trademark. This is true no matter what specific words are used, or whether the depiction is in the form of words or pictures.

Davis Facilitators are also obligated by the facilitator license to provide their clients with full and complete Davis programs, separate and distinct and in a separate context from any other services they may offer. It would never be appropriate for a Facilitator to develop or promote a different program that is based on combining Davis-based techniques with other services.

Thus, it would never be appropriate for a Facilitator site to specifically describe or depict Davis-based techniques or tools without using the “Davis” name, or in combination with descriptions of other different services or programs.

Inclusion in DDAI web site listing:

Web sites that do not reference the Davis program or utilize Davis trademarks will not be included in the Davis Facilitator listing on the www.davismetod.org web site, or in the list of links to facilitator sites at www.dyslexia.com
